Cannabis Regulation and Public Safety Measure

Two measures regarding cannabis will appear on the November 8, 2022 General Municipal Election ballot

  • Measure V: Maintaining the City’s Existing Prohibition of All Commercial Cannabis Activity
  • Measure MB: Cannabis Industry Measure Repealing Existing Prohibition and Requiring City to Approve Three Retail Cannabis Stores

On September 20, 2022, the City Council adopted Resolution No. 22-0135:

  • Supporting Measure V
  • Opposing Measure MB

Members of the public have asked, “What happens if both measures pass?”  If each measure receives a majority vote (50% + 1), state law states that the measure with the most votes prevails:   

 “If the provisions of two or more ordinances adopted at the same election conflict, the ordinance receiving the highest number of affirmative votes shall control.”  Election Code Section 9221.

Measure V conflicts with Measure MB, as stated in Measure V:

SECTION 1.  Intent; Conflicting Measure.  It is the intent of the voters that, pursuant to California Elections Code Section 9221, this Ordinance conflicts with Measure MB on the  November 8, 2022 General Municipal Election ballot and, if the measure adopting this Ordinance receives more affirmative votes, this Ordinance shall control and Measure MB shall have no effect.   

In sum, if Measure V receives at least 50% + 1 “yes” votes and more votes than  Measure MB, the status quo is maintained: the City’s voters have readopted the City’s existing prohibition of all commercial cannabis activity in the City and only the voters can eliminate the prohibition at a subsequent election.
