**NEW** The City Council adopted Ordinance No. 2023-0014, implementing permanent regulations related to SB 9 on December 19, 2023. Said regulations became effective on January 18, 2024.
What is Senate Bills (SB) 9?
- SB 9 requires that cities approve the following ministerially (with no public hearing):
- The development of up to 4 residences on an existing single-family residential zoned property.
- The split of an existing single-family lot into 2 parcels with up to 2 residences per parcel.
- SB 9 allows cities to voluntarily adopt a local ordinance with objective development standards for SB 9 projects.
Timeline
- 09/16/2021- Governor signed Senate Bill (SB) 9 into law.
- 12/21/2021- City Council adopts interim ordinance.
- 01/01/2022- SB 9 and Urgency Ordinance No. 21-0009-U go into effect and SB 9 projects may be submitted for review.
- 02/01/2022- Urgency Ordinance No. 22-0003-U goes into effect extending Urgency Ordinance No. 21-0009-U.
- 12/06/2022- Urgency Ordinance No. 22-0012-U goes into effect extending Urgency Ordinance No. 21-0009-U.
- A study session for the long-term SB 9 ordinance was held during the September 27, 2023 Planning Commission Meeting.
- The Planning Commission approved the long-term SB-9 ordinance at the November 8, 2023 meeting.
- The City Council adopted the long-term SB-9 ordinance (Ordinance No. 23-0014) to amend the Municipal Code at the December 5, 2023 meeting, which is now in effect.
What does this mean for the City?
Under SB 9, qualifying properties in the City have the potential for being split and/or being developed with up to 4 residential units.
What is the process for getting SB 9 projects approved?
- SB 9 projects will be reviewed through a ministerial process (i.e., no public hearing).
- Staff is actively developing an application for SB 9 projects, which will be available shortly on the Citizen Self Service webpage.
- The base application fee is $572.00, and does not include applicable surcharges or plan check and permit fees.
Things to consider for SB 9 projects
- LOCATION - Only properties that are zoned Residential Single Family (RS) are eligible for an SB 9 urban lot split and/or development of up to 4 residential units. Use the City’s mapping system (GIS) to identify a property’s zone.
- COVENANT – SB 9 projects require the execution and recordation of a covenant.
- DEVELOPMENT REGULATIONS - SB 9 projects will be regulated by state law (SB 9), existing City zoning regulations, and the City's permanent SB 9 ordinance.
