Reduce Food Waste from the Landfill
AB 1826: Mandatory Commercial Organics Recycling requires that businesses in California participate in an organics recycling program; required compliance is based on a tiered system of how much waste a business generates.
WHO MUST COMPLY?
- Commercial businesses must recycle all organics, including food scraps and yard/green waste.
- Multi-Family Dwellings with 5 or more units are required to recycle their yard/green waste (e.g.: landscaping) under AB 1826. Multi-Family Dwellings are encouraged to recycle food waste, but are not required to recycle food waste.
HOW TO COMPLY?
- Acquire food scrap recycling carts from the City's hauler Waste Management by calling (310) 830-7100 AT NO ADDITIONAL COST. The program is available as part of your base rate. All foods are accepted, even oily, fatty foods; no restrictions. Learn more about the City's food scrap recycling program here.
- Acquire green waste carts/bin from the City's hauler Waste Management if the business generates any yard/green waste.
WHEN TO COMPLY?
AB 1826 Implementation Dates and Thresholds
The law phases in the requirements for businesses, including multifamily residential dwellings that consist of five or more units,* over time based on the amount and type of waste the business produces on a weekly basis, with full implementation realized in 2019. Additionally, the law contains a 2020 trigger that will increase the scope of affected businesses if waste reduction targets are not met. The implementation schedule is as follows:
- April 1, 2016 (Tier 1): Businesses that generate 8 cubic yards of organic waste (food and yard waste) per week shall arrange for organic waste recycling services.
- January 1, 2017 (Tier 2): Businesses that generate 4 cubic yards of organic waste (food and yard waste) per week shall arrange for organic waste recycling services.
- January 1, 2019 (Tier 3): Businesses that generate 4 cubic yards or more of commercial solid waste (all types of waste) per week shall arrange for organic waste recycling services.
- Summer/Fall 2021 (Tier 4): If CalRecycle determines that the statewide disposal of organic waste in 2020 has not been reduced by 50 percent of the level of disposal during 2014, the organic recycling requirements on businesses will expand to cover businesses that generate 2 cubic yards or more of commercial solid waste (all types of waste) per week. Additionally, certain exemptions may no longer be available if this target is not met.
*Note: Multifamily dwellings are not required to have a food waste diversion program, but are required to participate in a yard/green waste program.
